SUBSTANTIVE DEFINITION OF LEGAL PHILOSOPHY IN RUSSIAN NEO-LIBERALISM
Abstract
Th e philosophical reconstruction of legal philosophy in the Russian neo-liberalism has been carried out in this article. Th e article points out that the diff erence between the exponents of the positivist and idealist schools in Russian neo-liberalism was in the understanding of the subject of philosophy itself. It has been found out that the methodological issues of philosophical reconstruction of the subject of legal philosophy in Russian neo-liberalism are concerned with defi ning the disciplinary status of legal philosophy, determining the interrelation between the subject evolution of legal philosophy and the subject of law in the context of the major trends of European philosophical and legal thought of the mid-19th and early 20th centuries. Th e infl uence of the “revived natural law” conception on the formation of the legal philosophy subject in Russian neo-liberalism has been studied. It is shown that the understanding of the nature of law in Russian neo-liberalism is the result of the critical examination of two philisopholegal paradigms: natural law and positivism. Refs 7.
