LIBERTARIAN PHILOSOPHY OF LAW: A CRITICAL ANALYSIS IN THE CONTEXT OF THE SOCIAL CRISIS IN RUSSIА
Abstract
Th is article on the basis of the philosophical analysis of the main provisions of the so-called libertarianlegal theory proves its conceptual failure and unscientifi c nature, as well as its discrepancy with the principles of humanism. Th e Utopian character of separating law and understanding of the content of the law from moral attitudes, as well as the feasibility of universal legal principles only in dialectical unity with the spiritual values of individual nations and civilizations are pointed out. Th e conclusion is that libertarianism is an ideological instrument of destruction of moral values and the most important social institutions in Russia. Refs 22.
